TERMS OF USE (EULA)

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and Vieolo OÜ ("Company," "we," "our," or "us") regarding your access to and use of the UniMark app ("App") available on the Apple App Store, Google Play Store, Chrome Web Store, and Firefox Extension Marketplace.

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

1. Eligibility

You must be at least 18 years old or have legal capacity under the laws of your country to enter into this agreement. By using the App, you confirm that you meet these eligibility requirements.

2. License

Subject to your compliance with these Terms, Vieolo OÜ grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the UniMark App on compatible devices that you own or control. This license is for personal, non-commercial use only unless otherwise agreed in writing by Vieolo OÜ.

3. Use of the App

You agree to use the App in accordance with all applicable laws, rules, and regulations. You must not:

  • Use the App for any illegal or unauthorized purposes.
  • Attempt to reverse engineer, decompile, disassemble, or modify the App.
  • Transfer, sell, or sublicense your license rights to another party.
  • Interfere with the security or integrity of the App.

4. Accounts and Data

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login information and are liable for all activities conducted under your account. Vieolo OÜ is not responsible for any loss or damage arising from unauthorized access to your account due to your negligence.

By using the App, you agree that we may collect and use technical and personal information as described in our Privacy Policy.

5. Subscription and In-App Purchases

Certain features of the App may be offered through a subscription model or one-time purchase. Subscriptions are billed on a monthly or annual basis, as selected by the user, and will automatically renew unless canceled before the renewal date. Prices for subscriptions and in-app purchases are subject to change with prior notice.

All purchases and subscriptions made via the Apple App Store, Google Play Store, Chrome Web Store, and Firefox Extension Marketplace are subject to their respective payment policies.

6. Content Ownership

All content, features, and functionalities of the App, including but not limited to design, software, text, graphics, images, and trademarks, are owned by Vieolo OÜ or its licensors. You may not use any of this content without our express written consent, except as permitted under applicable law.

7. Third-Party Services

The App may integrate or link to third-party websites or services. Vieolo OÜ does not control, endorse, or assume responsibility for any third-party services, content, or privacy policies.

8. Termination

Vieolo OÜ reserves the right to suspend or terminate your access to the App at any time, for any reason, without prior notice, including but not limited to breach of these Terms. Upon termination, your license to use the App will immediately cease.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Vieolo OÜ disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be error-free, uninterrupted, or secure, nor do we guarantee the accuracy or reliability of any content provided within the App.

10. Limitation of Liability

To the fullest extent permitted by law, Vieolo OÜ and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the App.

In no event shall Vieolo OÜ's total liability exceed the amount paid by you, if any, for accessing or using the App.

11. Changes to the Terms

We may update these Terms from time to time. You will be notified of any changes through the App or by other means. Your continued use of the App after changes are made will constitute acceptance of the revised Terms.

12. Governing Law

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.
